Attorney Lance Walters, of Tracey & Fox, reached a $100,000 settlement this week with an insurance company on behalf of the family of a pedestrian killed in north Harris County. The 29-year-old pedestrian was fatally struck by a pickup truck.
The victim’s survivors include his wife and three children. Walters worked to achieve a settlement to assist the family with medical bills, burial and future lost earnings. The national insurance carrier responded to settlement discussions after being notified of the firm’s involvement. Tracey & Fox has a proven track record of successful results when negotiating with an insurance carrier.
Walters said, “The family suffered a tragic and life-changing event and we’re honored to help them with the unexpected loss of a loved one. Although this does not bring back their husband, father, brother and son, it does provide for the family and their sudden financial expenses. The settlement exhausted the limits of the policy although we wish there was more available for the children.”
Pedestrian accidents have been on the rise and 25% of all traffic fatalities in the Houston-Galveston metropolitan area in 2016 were motor vehicle involving pedestrians. Dusk has been determined as the most dangerous time of day for pedestrians. Nearly 2,000 accidents in 2016 in the greater area including: Brazoria County, Harris County, Chambers County, Galveston County, and more, involved pedestrians and motor vehicles. Drivers may not be aware of a pedestrian zone or distracted by the many electronics competing for our attention. Accidents may occur from something as simple as a driver turning right and not checking for pedestrians.
Safety tips while walking include using a sidewalk if available, standing clear of large obstacles like buses, cars and hedges, and being alert while walking - even if in a protected zone. Not being distracted by phones, music and other entertainment helps pedestrians stay alert and aware of their surroundings.
